1. Acceptance of This Agreement
This User Agreement is a binding agreement between you and the operator of Loguw, referred to in this document as "Loguw," "we," "us," or "our." By downloading, accessing, purchasing within, or using Loguw, you agree to this Agreement and to our Privacy Policy.
If you do not agree, do not use the app. If you use Loguw on behalf of another person or organization, you represent that you have authority to accept this Agreement for them.
Nothing in this Agreement limits non-waivable consumer, privacy, or data protection rights available to you under laws that apply in California, Canada, Singapore, Australia, or your place of residence.
2. Loguw Services
Loguw is a lifestyle and creative utility for memory-inspired fragrance design. Depending on your device and app version, the app may let you:
- Import photos from your library or capture photos with your camera after you grant permission.
- Analyze photos on device to extract dominant colors, visual mood, broad memory categories, and fragrance note suggestions.
- Create, save, edit, favorite, and browse fragrance formulas and memory stories.
- Store collections, growth records, achievements, and anniversary reminders locally on your device.
- Purchase consumable coins through the App Store to unlock or use eligible app functions.
Loguw does not provide medical, psychological, safety, chemical, commercial perfumery, or professional advice. Any fragrance ideas, notes, stories, categories, or memories generated by the app are for personal creative inspiration only.
3. Eligibility and Accounts
You may use Loguw only if you can form a binding agreement or if your parent or legal guardian consents to your use. The app is not directed to children under 13, and it should not be used by anyone under the minimum age required by applicable local law without appropriate guardian consent.
Loguw currently operates primarily without a Loguw account. Certain functions may rely on your device, Apple App Store account, app permissions, local storage, and platform settings.
4. Your Photos, Memories, and Other Content
You are responsible for the photos, titles, stories, formulas, and other content you create, import, save, or edit in Loguw. You represent that you have the rights and permissions needed to use the content in the app and that your use will not violate another person's privacy, publicity, intellectual property, or other rights.
As between you and Loguw, you keep ownership of your content. You grant Loguw the limited permission needed to process, display, analyze, store, and otherwise operate app features on your device or through any services you choose to use.
You understand that photos may contain personal or sensitive information about you or others. Please obtain consent before importing or using images of other people where required by law or reasonable privacy expectations.
5. Consumable Coins, Payments, and Refunds
Loguw may offer optional consumable coin products. Coin packages, prices, availability, promotions, and eligible uses may change from time to time. Coins have no cash value, are not legal tender, are not transferable outside the app, and may only be used for eligible Loguw functions.
Purchases are processed by Apple through the App Store. Your purchase, billing, tax, refund, family sharing, and payment method rules are governed by Apple's applicable terms and policies. We do not receive your full payment card information.
Except where required by applicable law or App Store policy, consumable purchases are final once delivered or consumed. If a purchase fails, is duplicated, or does not appear in the app, contact us at loguwcyl@163.com and use Apple's refund tools where applicable.
6. Acceptable Use
You agree not to misuse Loguw or help anyone else misuse it. You must not:
- Use Loguw for unlawful, deceptive, infringing, harassing, abusive, discriminatory, or harmful purposes.
- Import or create content that violates privacy, image, intellectual property, or consumer protection laws.
- Attempt to reverse engineer, tamper with, bypass security for, disrupt, scrape, or overload the app or its purchase mechanisms.
- Use the app to identify, profile, or make legally significant decisions about another person.
- Misrepresent app-generated fragrance suggestions as professional, medical, chemical, or safety advice.
7. Loguw Intellectual Property
Loguw, including its app design, interface, visual system, software, fragrance inspiration engine, seed data, text, graphics, logos, and other materials, is owned by us or our licensors and is protected by intellectual property laws. You receive a limited, personal, revocable, non-exclusive, non-transferable license to use Loguw for lawful personal purposes.
You may not copy, resell, sublicense, distribute, or create competing services based on Loguw except as allowed by law.
8. Platform and Third-Party Services
Loguw depends on device features and Apple services, including photo library access, camera access, notifications, local storage, and App Store in-app purchases. Those services are controlled by Apple or your device provider, and their terms and privacy policies apply to your use of those services.
We are not responsible for third-party outages, platform policy changes, device settings, operating system restrictions, or App Store decisions.
9. Disclaimers
To the maximum extent permitted by law, Loguw is provided "as is" and "as available." We do not promise that the app will be uninterrupted, error-free, secure, compatible with every device, or that creative suggestions will be accurate, complete, or suitable for any particular purpose.
Visual analysis, mood labels, categories, note recommendations, anniversary prompts, and story suggestions are automated creative outputs. They may be incomplete, subjective, or incorrect and should be reviewed by you before use.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Loguw will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, content, goodwill, or business opportunity, arising from or related to your use of the app.
Where liability cannot be excluded under applicable consumer law, our liability is limited to the remedies required by that law. Some regions do not allow certain exclusions or limitations, so some of the above limits may not apply to you.
11. Regional Consumer and Privacy Terms
California
If you are a California resident, this Agreement does not waive rights under California consumer protection law, the California Consumer Privacy Act as amended, or other non-waivable California rights. Our Privacy Policy explains California privacy rights, including access, deletion, correction, opt-out, limitation, and non-discrimination rights where applicable.
Canada
If you are in Canada, this Agreement is intended to be read consistently with Canadian privacy and consumer protection requirements, including PIPEDA and substantially similar provincial laws where applicable. You may contact us to ask questions, withdraw consent where available, request access or correction, or challenge our privacy practices.
Singapore
If you are in Singapore, privacy-related requests may be sent to the contact email listed below. We will handle personal data requests in accordance with Singapore's Personal Data Protection Act where it applies.
Australia
If you are in Australia, nothing in this Agreement excludes, restricts, or modifies guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law or rights available under the Privacy Act and Australian Privacy Principles where applicable.
12. Changes, Suspension, and Termination
We may update Loguw or this Agreement to reflect new features, operational changes, legal requirements, or security improvements. If a change materially affects your rights, we will use reasonable methods to notify you, such as an in-app notice or an updated effective date.
We may suspend or limit access to features if needed for security, legal compliance, platform requirements, fraud prevention, app maintenance, or misuse of the app. You may stop using Loguw at any time and may delete local app data through app or device controls where available.
